This User Agreement (Agreement) is a legal instrument between Projobo.com (Projobo or “website” or “site”) and the members of Projobo.com. This Agreement governs the existing as well as any future services offered by the website. By completing the registration process, you hereby give your consent to be bound by the following clauses (as amended from time to time). No separate written Agreement is entered into by the website with any of its members. This Agreement implicitly, explicitly, and exclusively lays down all the legal obligations of the website and its members. If any of the following clauses or the provisions contained in the Privacy Policy are unacceptable to you, kindly cease the usage of this website with immediate effect.

ELIGIBILTY
To participate in the bidding process on this website, you must be strictly of the age that is considered as a valid age to enter into a legally binding Agreement as per the applicable law. By making a bid on a project on the website, you represent and warrant that –

1. you have the right, authority, and capacity to enter into this Agreement;
2. you will abide by all the clauses mentioned under this Agreement;
3. you are of the age of majority as applicable and defined under the relevant applicable laws;
4. you will not permit any minor (a person below 18 years of age) to use your membership by proxy to take part in the bidding process on this website.

Irrespective of your eligibility, Projobo.com has an absolute discretion whether, or not, to accept your membership request for participation in the bidding process on this website.

TERM AND TERMINATION
The term of this Agreement is the duration of your usage of this website either as a member or a user or a visitor or in any other capacity that entails availing any of the services available on this website under the explicit terms.

The members can terminate their membership of this website at any time, without providing reason, by simply contacting us. In such a scenario, we will remove the member’s details from our active database. But detailed records will be securely kept on our servers to meet certain current and possible future legal obligations.

Projobo.com reserves the right to terminate the membership of any member at any time if such member is found to be violating one or more of the provisions contained in this Agreement.

DESCRIPTION OF SERVICES
The services offered by Projobo.com are in the nature of acting as a link between the local service providers and the people in need of services. All the services are provided on an AS IS and AS AVAILABLE basis and Projobo.com disclaims all responsibility and liability for the availability, timeliness, security or reliability of the services provided by this website.

Presently, the services provided on this website are totally free of any charges. Projobo.com reserves the right to convert the free service to paid one at any time without assigning any reason whatsoever. However, should we decide to charge any fee/commission from the members on the services provided through Projobo.com, all the members will be appropriately informed about the time of commencement and other relevant details regarding any change.

Very briefly, the working model of Projobo.com can be described thus. The members in need of any service from the local providers pertaining to the field of renovation, construction, parties and event organization, office-related tasks, house keeping, care taking etc., post their requirements in the form of a project on Projobo.com. The interested members who are the service providers in the relevant field bid on the project. The listing member reviews the bids and selects the provider bet fitting his requirements. In case no acceptable bid is received, the listing member cancels the listing. The service charges to the service provider are paid as per the negotiations between the employer and the service provided. A detailed working about the site is available here.

Projobo does not check the legal status of the providers who agree to deliver the desired service they are bidding on. All the requirements regarding checking of licenses and permits of the providers shall be the responsibility of the member seeking to avail the services of such provider, and Projobo shall not be questioned in this regard in any manner whatsoever.

The services provided by Projobo are for use only under a non-exclusive, non-transferable, and non-assignable license under the clauses contained in this Agreement. We do not authorize any member to copy, sell, or otherwise exploit for any commercial purpose the services or content, in whole or in part, access to, or use of this service.

After a project is completed, the participating members can leave feedback and rate the experience of working with each other. Though this is helpful, yet it does not provide a foolproof data of knowing whether the employer or worker is right to work with. We disclaim the genuineness, or otherwise, of the respective members operating through this website. We SHALL NOT BE RESPONSIBLE for any transaction between the members inter se pertaining to a project listed on Projobo.com. We do not control, research, verify, validate, or approve the content posted by the members on this website. The members are expected and responsible for conducting adequate research about each other before finalizing a project listed on this website.

THIRD PARTY CONTENT
Projobo.com provides unmonitored access to third party content. We are just a website responsible for the content contained on Projobo.com. Any links or banners or ads belonging to a third party, but appearing on Projobo.com shall be the sole responsibility of that third party. WE DISCLAIM any liability based on or related to the third party content on this site, whether arising under the laws of copyright or other intellectual property, defamation, libel, privacy, obscenity, or any other legal discipline. Further, Projobo.com does not control nor review the web sites of such third parties and therefore, does not endorse the content, products, services, practices, policies, or performance of the websites linked from Projobo.com. Your dealings with the linked third parties shall be subject to the policies and legal requirements of those websites. The clauses contained under this Agreement shall not be applicable for any dealing with the linked websites.

FEES AND COMMISSIONS
There is NO JOINING FEE to become a member of this website.

Projobo.com reserves the right to change its fees, fee-structure, and commissions from time to time in its discretion.

PAYMENTS
Currently, Projobo does not handle any payments from its members. All the payments are directly made between the members owing to the local nature of services catered to by this website.

1. By submitting any content to Projob.com (including, but not limited to creating an Account, posting a resume, posting a profile, posting a portfolio, posting a Project; sending messages through or to Projobo.com), you, hereby, grant to Projobo.com a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, and display, this content.
2. Members are encouraged to post their contact information to allow the project creator to check the provider’s service record and license status. And the project creators are also encouraged to post their contact information to facilitate a jobsite inspection or other pre-bid activity. Projobo is intended to serve its members as an advertising platform.
3. The members are strictly prohibited from negotiating or dealing with another member directly (i.e., outside of Projobo.com) before the closure of project. This would result in immediate suspension and possible termination of membership of the infringing member.
4. The members are not allowed to seek or make hourly bids. For continuous projects (e.g., weekly cleaning), only a minimum monthly bidding amount is permissible. The only bids allowed pertain to the total cost of the project.
5. The members are prohibited from using any feature of this website, either intentionally or unintentionally, for violation of any local, national, or international law or treaty.
6. The members are prohibited from impersonating any person or entity, including, but not limited to, a Projobo official or employee or falsely state or otherwise misrepresent their affiliation with a person or entity.
7. The members are prohibited from publishing any content, through the media available on Projobo.com, which constitutes the intellectual property of a third party.
8. The logos, names, design, and content of Projobo.com are the exclusive intellectual property of Projobo LLC. No one is authorized to use any of the intellectual property belonging to Projobo LLC through Projobo.com without written permission and prior approval of Projobo LLC.
9. The members are prohibited from uploading or posting any e-mail ID or otherwise transmitting or posting links to any content that facilitates hacking, spoofing, Phishing, spamming, virus dissemination, and other such cyber offences that tend to undermine the harmony in a civilized society.
10. The members are prohibited from using such language through the media provided by Projobo.com that amounts to harassment, defamation, vulgarity, obscenity, child pornography, libel, invasion of privacy, racism, or otherwise illegal and opposed to the common sentiments shared by civil society.
11. The members are prohibited from uploading or sharing of purely marketing material, either of himself/herself or of any third party, except when sharing of such material is vital vis-à-vis the project requirements.
12. The members are prohibited from creating multiple user accounts to avoid fees, suspension or bad ratings on Projobo.com.
13. Projobo.com does not provide assistance for any project deliverables between the members.
14. In no event shall Projob.com be liable for lost profits or any special, incidental or consequential damages arising out of, or in connection with this site, its services or this Agreement, however arising.

INDEMNITY
You agree to indemnify and hold Projobo.com and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your use of this website, your violation of this Agreement, your violation of any rights of another, or any other loss suffered by Projobo on account of your direct or indirect conduct.

EXCLUSION OF LIABILTY
Projobo SHALL NOT BE LIABLE for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use this website, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if Projobo has been advised of the possibility of such damages.

In some States or Jurisdictions, which do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, the above limitations or exclusions may not apply. In these cases, the liability of Projobo shall be limited to the greatest extent permissible by law.

PRIVACY
The use of this website is governed by our Privacy Policy, which may change from time to time.

MODIFICATIONS OF SERVICE
Projobo reserves the right to modify or discontinue, temporarily or permanently, Projobo.com, or any part thereof, with or without notice, at any time and from time to time. You agree that Projobo shall not be liable to you or to any third party for any modification, suspension or discontinuance of this website.

SEVERANCE
This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is declared unlawful, void or unenforceable by a Court of Law, that provision is deemed severable from this Agreement, and does not affect the validity and enforceability of the remaining provisions.

JURISDICTION
All disputes arising out of, or related to, this User Agreement, or your relationship with Projobo shall be subject to the laws and courts of the State of California in particular and to the laws and courts of the United States of America in general.
